Three injured when makeshift wall collapses

November 5th, 2013 • premises liability

The torrential downpour in New York may have been a factor in the accident that caused three individuals to be injured. The individuals were by Times Square when falling objects, including a massive plywood construction wall, came crashing down on them.

Several witnesses were nearby and began acting as Good Samaritans, several of whom helped lift the green construction wall off of the victims that were trapped underneath. A witness reported hearing somebody yell that someone was under the wall. He also reported that about 25 people helped to lift the wall up off of the victims. A city Buildings Department official said that the construction scaffolding was blown down by the high winds because it had not been properly secured to the building at Seventh Avenue as required. The official said that the construction group that was working at the site is based out of Texas and has received citations for safety violations and a stop-work order. However, the head of the construction group said that the accident was not the company's fault as it was only working on the interior of the building and not the exterior work.

Firefighters arrived at the scene of the accident within a few seconds after the Good Samaritans had lifted the construction wall off of the victims. They also helped block other pedestrians from entering the area. One middle-aged woman was pulled out from under the wreckage who was bleeding from her forehead and crying. Another middle-aged woman and a man were also pulled out from the debris. All three victims were treated at the scene and transported to the hospital.

An attorney may be of service to someone who was injured due to the negligent actions of another party. An attorney may help the victim pursue compensation for damages through a premises liability lawsuit. If successful, the injured party may receive reimbursement for medical expenses, lost wages and pain and suffering.
